Our legal consultants agree. June be declared a “NO TEXTING WHILE DRIVING MONTH”, mostly due to the increasing number of injuries reported causing major accidents and the impact on the number of lives and families affected by such unintended seemingly simple actions.
At the Victor Law Center, PA, we have become familiar with the unintended consequences of this very important issue. There was a time when celebrities like Oprah Winfrey to name one of the most impactful voices, was used to bring great awareness and for a good while the number of car accidents caused by negligent drivers while texting and or otherwise using cellular phones had significantly decreased.
However, the campaign has died down over the years and consequently we are seeing the numbers rise again. Recent statistics appear to indicate a rise in car accidents, wrongful deaths and countless personal injuries stemming from the rise in failure to use due care involving operators of vehicles, motorcycles and trucks, resulting in deaths and serious injuries from accidents being on the rise once again mostly involving cell phones.
Practicing personal Injury law for over 25 years and having legally represented a countless injured victims from automobile accidents, motorcycle crashes, wrongful deaths, dog bites,slip and falls and various injuries matters from all types of negligence from others has taught me and our caring Personal Injury trained Legal Staff to bring back the need for bringing back the awareness and the importance of ways to remind drivers to refrain from driving and using their cell phones at the same time.
Most drivers, particularly speaking for the ones on the roads of South Florida are too aware of the split second danger of shifting their attention from the road to tend to a ringing cell phone or texting someone resulting in injuries and the catastrophic costs of such simple
No driver purposefully gets behind the wheel of a two ton weapon with the intention of causing accidents, deaths or any other type of harm to others and or themselves.
What makes the most sense in the real world does tend to escape us at times. INCLUDING YOURS TRULY. I have caught myself attempting to grab my cell phone to answer a call WHILE DRIVING. I’m grateful that usually I’m quickly reminded of the need to resist the urge to engage in such activity while operating a vehicle.
However not all drivers on the road remember to practice what we all preach, especially to our loved ones, thereby preventing car accidents and injuries caused by the simple act of tending to cell phones while operating vehicles or trucks or engaging mechanisms which automatically shift our attention away from focusing on the road and ESPECIALLY OTHER DRIVERS ON THE ROAD WHO ARE NOT PAYING ATTENTION TO DRIVING THEIR CARS WITH DUE CARE, THEREBY RESULTING IN CATASTROPHIC ACCIDENTS DEATHS AND COUNTLESS PERSONAL INJURY TO OTHERS, AFFECTING A SIGNIFICANT NUMBER OF FAMILIES AND THE TREMENDOUS AMOUNT OF LOSS OF LIVES, CHANGING THOSE FAMILIES’ PLANS FOR THEIR FUTURES AND SO ON AND SO ON…
Needless to say, our choice of focus this month of June, 2019 HANDS DOWN GOT THE BLESSING FROM NUMEROUS FAMILIES AND COLLEAGUES FROM THE LEGAL AND MEDICAL COMMUNITIES IN AN EFFORT TO REMIND EACH OTHER SOMETHING WE ALREADY ARE TOO FAMILIAR WITH HOWEVER SELDOM BELIEVE WILL HAPPEN TO US PERSONALLY.
MY LATE PARENTS, Cade and Francesca Destin Victor, had the parental abilities to MAKE ALL EIGHT OF US FEEL ASHAMED WITHOUT USING A SINGLE WORD. JUST ONE LOOK FROM EITHER OF THEM BUT MOSTLY OUR DAD, WOULD CONVEY IN A SPLIT SECOND WHAT WE WERE DOING WRONG AND WE KNEW TO GET WITH THE PROGRAM INSTANTLY. OUR LATE MOTHER, A TRUE ANGEL, WHO RAISED EIGHT CHILDREN SUCCESSFULLY AND PUT UP WITH HER HUSBAND FOR NEARLY SIXTY YEARS USED A COMPLETELY DIFFERENT METHOD, WHICH BY THE WAY WORKED ON ALL OF US FROM MY OLDEST BROTHER, JACQUES TO THE YOUNGEST, YOURS TRULY. FRANCESCA DESTIN VICTOR HAD A FAMOUS SAYING WHICH HAD THE ABILITY TO CALM ANYONE DOWN FROM THE WORSE MINDSET. USING MY YOUNGER SELF AS AN EXAMPLE, GROWING UP THE YOUNGEST OF EIGHT KIDS CAME WITH ENOUGH ISSUES AT LEAST FROM THE MINDSET OF THE YOUNGEST CHILD. WHENEVER I WOULD BE THE MOST ANGRY AT WHATEVER I THOUGHT WAS A GREAT INJUSTICE TO MYSELF AND BEING BLESSED ENOUGH BACK THEN TO HAVE SOMEONE LIFE MY MOTHER WHO HAPPENED TO BE MY CLOSEST FRIEND BACK THEN, I WOULD CONFIDE MY MOST VENGEFUL PLAN TO GET JUSTICE FOR MYSELF FROM WHATEVER UNFAIRNESS I HAD SUFFERED AND THERE WERE MANY.
MY MOTHER WOULD LISTEN QUIETLY AND ALLOW ME THE TIME TO FUME AND RANT AND RAVE ABOUT REVENGE. THEN SHE WOULD SIMPLY LOOK AT ME AND SHARE THE FOLLOWING:
“HONEY, I KNOW HOW YOU MUST FEEL. ESPECIALLY WHEN YOU’RE THE YOUNGEST AND YOU HAVE TOLD ME MANY TIMES YOU FEEL YOU HAVE NO VOICE AND NO POWER AND NO ONE EVER LISTENTO YOU AND EVERYONE DOES WHATEVER THEY WANT TO YOU. BUT WHAT YOU JUST TOLD ME YOU PLAN ON DOING TO GET REVENGE? TING, (that was my nickname because I ate a lot of candy and not enough food which caused me to be very skinny and short) HONEY, WE DON’T DO THAT. IN THIS FAMILY, EVEN WHEN YOU FEEL TOTALLY DISRESPECTED BY SOMEONE, YOUR ACTIONS WILL HAVE SERIOUS CONSEQUENCES. AND TING, YOU’RE SITTING HERE TELLING ME WHAT YOU PLAN ON DOING, HONEY, THAT’S NOT HOW WE SOLVE OUR PROBLEMS. YOU CAN BE UPSET. I UNDERSTAND BUT HOW ABOUT YOU REMIND YOUR BROTHER THAT WHAT HE DID CAUSED YOU PAIN AND EXPLAIN HOW YOU FEEL?”
For decades, although I loved my mother more than anyone else in the world except for my two boys, I used to think that my mother was a pushover who always had a kind word and unlimited amount of wisdom to waste on others who didn’t necessarily understand her greatness nor were deserving of her kindness and caring attention.
As I grew older, raising my own family and especially serving our clients throughout the past 25 years not to mention kissing my my fifties goodbye soon enough have conspired to bring me back to those priceless moments, I have and continue to appreciate my mother’s wisdom especially through my professional experiences serving and caring for victims of negligence and personal injuries, the immediate impact on their close family members, all of which gradually bring me back to my mother’s countless but unappreciated moments and the simple exchanges which continue to impact my daily life.
Thankfully I have gotten so much more than I deserve from my childhood and treasured moments with my best friend. I can’t think of any single day when something somehow doesn’t bring me back to the frequent Francesca Destin Victor’s words of wisdom.
This morning I’m at my desk, thinking of a topic of choice for a legal blog. And there you have it South Florida. Nearly all of you would have loved having a mother like Francesca Destin Victor. And using HER WISDOM TO DRIVERS WHO NEVER INTEND ON THE SIMPLE ACT OF ANSWERING THEIR CELL PHONES OR SENDING A QUICK TEXT. ALLOW ME TO PASS ON WORDS OF WISDOM FROM ONE THE GREATEST AND KINDEST HUMAN BEINGS I WAS FORTUNATE ENOUGH TO HAVE IN MY LIFE:
